Smoking Ban French overseas territories from July 1st, 2025

Starting July 1st, 2025, a brand-new law comes into effect on the French side of Saint-Martin: smoking is banned in many public spaces, including beaches, parks, bus stops, and areas around schools and daycare centers. This rule isn’t just local – it applies across all French overseas territories, including Guadeloupe, Martinique, St. Barthélemy, and mainland France.

What’s allowed – and what’s not?


If you light up a traditional cigarette in one of the banned areas could now cost you a fine of at least €135. However, vaping and e-cigarettes are not affected (yet) – so while smoking is off the table, vaping is still technically permitted in those areas.

Why the Smoking Ban?


The idea behind this change is to make public spaces cleaner, healthier, and more enjoyable – especially our stunning beaches. No more cigarette butts in the sand, no more smoke drifting from the towel next to yours. Families with kids and non-smokers can now enjoy the beach with fresher air, less cigarette butts and fewer distractions.

How does the Smoking Ban affect your island adventures with us?

If you’re joining us on one of our island tours, this is great news! Whether we’re stopping at Panorama view points, visiting local places, or relaxing at hidden beaches, the experience will be even more peaceful and pristine.
Of course, designated smoking areas still exist — mainly near cafés or bars. And on the Dutch side (Sint Maarten), things remain more relaxed: smoking is still allowed in many public places.

Our take on the Smoking Ban?

Although it would have been much better if these laws were not even needed to be considered, we think this law is a step in a new direction. It’s a win for sustainable tourism, families, and everyone who loves nature. Let’s be honest: nobody likes stepping on a soggy cigarette butt in paradise.

That said, we’re curious to see how this law will actually be enforced. Like with many things in the Caribbean, implementation may take some time — but the intention is clear: a cleaner, healthier island for everyone.

    Sad! What about a plastic bottle ban? We never let our cigarettes butts on the beach or any kind of rubbish. But smoking belongs to our kind of enjoyment and relaxing. SXM French side was our paradise because of the liberalness and little bans! Ok, next time Dutch side.

      Like mentioned we are pretty sure it will not be enforced in Saint-Martin.
